If i have signed a tenancy agreement, no money paid yet can we change our mind?

We’re due to move in on Monday (it’s now Sat), keys have been given to us so we can clean b4 moving. The landlord only has our names as i am due to arrange a direct debit to pay rent into. Would we liable if we didn’t move in if we told him on Monday we’d changed our minds??

So long as you have not moved anything into the property then no tenancy has been created. This means that your will be liable for any costs that you changing your mind has cost the landlord, but you won’t be tied into the full 6 or 12 months rent that you signed up for.

In the real world – don’t expect to get back any deposit you may have paid.

    If you have paid the deposit, you will lose the deposit.

    If you have not paid the deposit, tell him you don’t want the place.

    You may be liable for one month rent, but tell him try and take you to court – it will cost him even more.

    If you’ve signed a contract that is legally binding however if literally the ONLY piece of information landlord has bout you is your name then it would be difficult to contact you if you just didn’t show up.

    Surely landlord has requested deposit, ID, references?? Taken your current adress and number details??

    If they haven’t then that’s their choice but if you are caught then legally you are liable for the contract costs.

    In signing the tenancy agreement you have entered into a legal contract. But if have dealt direct with the Landlord and all he knows is your names i guess you could just give the keys back. But if you got to the Landlord via an agent then the agent would have taken all your details. It is VERY unusual for a Landlord to give keys to anyone before the deposit has been paid and reference and the usual checks have been done.

    As you have not paid rent a tenancy has not been created. The landlord could pursue you for breach of contract but as it would cost him an arm and a leg that is most unlikely. Do the decent thing and tell him asap.
